Wood Stairway Handrail Code Violation

Don't get me wrong, this wood handrail can easily be gripped onto by most people, the problem is that it probably won't pass current building codes.

The illustration below will provide you with a better example of what most current building codes require, but keep in mind the stairway could've been built years before these codes became active. For example, current building codes also require a minimum of 4 inches between stairway balusters and these almost look like they're 12 inches.
