Wood Stairway Handrail Code Violation

Don't get me wrong, this wood handrail can easily be gripped onto by most people, the problem is that it probably won't pass current building codes.

For example, current building codes also require a minimum of 4 inches between stairway balusters and these almost look like they're 12 inches.
